Recreational and Governmental Immunity in Wisconsin
Wisconsin’s Recreational Immunity Statute, enacted in 1984, shields an owner from liability for injuries occurring on property when the person injured is engaged in a recreational activity. In this update to his 2007 book, Attorney John Becker analyzes the current scope of this law. More than just a reference book to the various provisions of the statutes and the cases that have dealt with those provisions, including complete summaries of those cases, it also traces the development of the law since its enactment. It provides a comprehensive analysis of the statute, its legislative history, and the evolution of the courts’ interpretation of the statute over the past four decades.
Further, the book includes a new section on governmental immunity. In researching and writing this book, and its companion, Wisconsin Safe-Place Law, Third Edition, Attorney Becker noted a lack of consistency among cases applying the rule of governmental immunity. He added this part of the book to suggest ways to reconcile these cases and provide some analysis regarding how the rule is to be applied.
